By accessing or using CaptionWala ("Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. These terms are governed by and construed in accordance with the laws of India.

2. Description of Service

CaptionWala is an AI-powered platform that generates social media captions for Instagram, YouTube, and other platforms using Anthropic's Claude AI technology. The Service is available in Free, Starter, Pro, and Agency subscription plans.

3. User Accounts

• You must be 18 years or older to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and complete information during registration.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use Policy

You agree NOT to use CaptionWala to:

• Generate content that is illegal, defamatory, harassing, or harmful
• Create spam, misleading advertisements, or fraudulent content
• Infringe intellectual property rights of others
• Violate any applicable Indian or international laws
• Attempt to reverse engineer or hack the platform
• Share account credentials with others (except Agency plan multi-user features)
• Generate content promoting violence, hate speech, or discrimination

5. Subscription and Payments

• Plans are billed monthly. Payments are processed by Razorpay.
• Subscriptions auto-renew unless cancelled before the renewal date.
• All prices are in Indian Rupees (INR) inclusive of applicable taxes.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.
• Refund policy is governed by our separate Refund Policy page.

6. AI-Generated Content

Captions generated by CaptionWala are AI-generated. You acknowledge that:

• AI outputs may occasionally contain errors or inaccuracies.
• You are responsible for reviewing content before publishing.
• CaptionWala does not guarantee virality or engagement results.
• You own the rights to captions you generate through our platform.

7. Intellectual Property

CaptionWala's brand, logo, interface, and underlying technology are owned by us. Generated captions belong to the user who created them. You grant us a limited license to process your inputs solely for the purpose of providing the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law, CaptionWala shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your access to the Service will cease. You may request export of your data before termination.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Jaipur, Rajasthan. We encourage resolution through mediation before litigation.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or prominent notice on the website. Continued use constitutes acceptance.
